I have first-hand knowledge that Council’s are not spending money obtained through S106 legal agreements tied to planning permissions in the proper manner. I have stated this in my websites since 2009.

Now, an investigation by the BBC has revealed that Councils’ in the east of England alone are sitting on nearly £250 Million of unspent planning gain cash. The National toll is in the order of 1.5 Billion...Yes Billion!

Being responsible for a team monitoring S106 legal agreements while employed in Local Government, I know that many Councils are not effectively monitoring S106 agreements in their area.

Financial contributions acquired through legal agreements should be spent by the Council in accordance with the terms of the agreement. Some S106 agreements have ‘claw back’ provisions.

If the LPA has not spent the money in the proper manner or in the given time, it may give you an entitlement to those monies back. With Local Government experience in this area and a working knowledge of the Freedom of Information Act, I am well placed to help you look for the monies you may be legally entitled to.
